A den built from by teenagers in Beer has been reprieved from demolition by East Devon District Council.

The makeshift shack had been built from old pieces of wood on a concrete slab near Jubilee Gardens, and was being used as a meeting place.

But last month they found a notice from EDDC affixed to their den, saying it was on privately-owned land and their occupation of it was ‘unauthorised’. They were ordered to remove all their belongings from it by yesterday (Tuesday, February 7). It was reported that just one complaint about the den had led EDDC to take action.

The council later said there were ‘numerous health and safety issues’ and they had no choice but to remove the structure.

Beer parish councillor John Heath took up the boys’ case, saying EDCC should have consulted his council before taking action, and adding that it was unfair to single out the den when all of Jubilee Gardens were in need of maintenance work by EDDC. The story was picked up by the national press.

Now, East Devon District Council has agreed to work with the parish council to find a better solution.

'We now understand this is a community project'

A spokesperson for EDDC said: “To confirm, it was brought to our notice that a ‘shack’ had been built on a site under the Undercliff in Beer on East Devon District Council land. As would be our normal procedures our staff investigated this.

“Upon investigation a structure was found made from drilled-together wooden pallets, along with a fire pit, rope swing, beer cans etc. During this and a subsequent inspection a number of health and safety issues were identified such as screws sticking out and sharp bits of timber. It has been subsequently confirmed by the council’s legal team that the council would be liable if any accidents were to happen or someone was injured from this construction.

“We now understand this is a community project and are in discussion with Beer Parish Council on the steps they would like to take to find a more appropriate solution moving forward.”

“The Jubilee area of Beer is very much managed as a natural area with woodland, lots of habitat and dog walking paths throughout. Times have changed where every green space is tightly manicured but we are seeking to continually improve areas so would encourage residents to report to the council any feedback or specific issues about this space and the parks team will then review or action.”

Cllr Heath has welcomed the decision, but said EDDC should have consulted Beer Parish Council in the first place.
