Man, 68, who abused a power of attorney is told he faces a jail sentence

An Axminster pensioner has admitted stealing £67,000 by abusing a power of attorney.

William Stuckey changed his plea on what was scheduled to be the first day of his trial at Exeter Crown Court.

Stuckey, aged 68, of Dukes Way, admitted committing fraud between March 2009 and May 2011 by abusing his position as power of attorney.

The charge alleges he failed to safeguard the interests of David Swift and using money for his own benefit.

Recorder Mr Llewellyn Sellick adjourned the case for a pre sentence report and to allow Stuckey time to make arrangements for repaying the money.

Mr Gary Venturi, prosecuting, said the plea had been entered on a basis which is acceptable and which acknowledges a figure of £67,000. He said it is hoped an application under the Proceeds of Crime Act can be dealt with at the time of sentence on an agreed basis.

Mr Harry Ahuja, defending, said it is expected that the total amount will be repaid but there is an issue of a property which is currently tied up in probate but which may be sold or re-mortgaged in due course.The judge warned Stuckey that all sentencing options are open and told him: “You should expect a custodial sentence. The sentence date will give as long a time as possible to make progress in arranging for the money to be repaid.”
